Sense Health b.v. is founded on the principle that users should keep ownership over their personal data. We know that you care about how your personal data is used and shared, and we take your privacy very seriously.

In this privacy policy Sense Health b.v. can also be referred to as “Sense Health”, “we”, or “us”. By using the Sense Health Services (i.e., any of the digital and mobile solutions we provide or are provided on behalf of us, including the NiceDay App and Website), you are accepting the practices outlined in this privacy policy.

This Privacy Policy covers Sense Health’s treatment of personal information and data that Sense Health gathers when you use any of the Sense Health services. “Personal information” for purposes of this Policy means information that identifies you, such as your name or email address. “Personal data” for purposes of this Policy means data that you gathered from connecting and uploading data to NiceDay. In the following paragraphs we answer the most important questions regarding privacy. If you have a question which is not listed below, please contact support@nice-day.nl.

What happens to my personal data?

You are the owner and controller of your data. The Sense Health Services enable you to control your data in the app. You being the owner and controller of your data means that you decide what happens with the data. You can download or delete your data by sending a request to support@nice-day.nl. Once you delete your account we will delete all data associated with that account, with the exception of anonymous usage statistics.

What personal data is collected?

We collect data from several sources. The main source of data is information you provide yourself, such as information regarding events you undertake, and feelings or thoughts you experience. In some instances we can also collect other data sources provided by your device, such as step count or distance walked. We will always send you a request prior to collecting such data, so you can adjust your preferences accordingly. Finally, we collect anonymous usage statistics to optimize the app and give you a better experience.

Are there any situations in which third parties will have access to my personal data?

Third parties such as health professionals and therapists will only have access to your personal data (either in anonymous, aggregated, or personally identifiable formats) in case you provide that access to them. You can at all times revoke that access from them. We permit ourselves the right to use your data in aggregated form to improve the Sense Health services and learn from your usage of the service. In addition, our hosting providers may gather anonymous usage statistics to improve their services. They never have access to your personal information or personal data. If you are registered at a health institution, this institution may make additional agreements with you regarding the access and sharing of your personal data. All information shared between you and your therapist or health professional is strictly confidential and will never be shared with a third party. Health professionals may gather usage statistics in aggregated form and report them to their stakeholders with the goal of measure the effectiveness of NiceDay. Information in these reports will never be attributable to individual users.

Is my data safe?

We use a combination of firewall barriers, encryption techniques and authentication procedures, among others, to maintain the security of your data and to protect User accounts and systems from unauthorized access. However, as internet data transmissions cannot be guaranteed to be 100% secure, you acknowledge that you collect and possibly share your data at your own risk. Sense Health and you as a user carry a shared responsibility to treat your data with care.

For your privacy and security, you are required to enter a secure password when you register for the Service. This password is stored in an encrypted fashion on our systems.

It is important to understand that these precautions apply only to our website and systems. We exercise no control over how your information is stored, maintained or displayed by third parties or on third­party sites, and we exercises no control over what happens when you have shared your data with third parties.

Use of an operating system different than the one supplied by your phone manufacturer, or modifications to the stock operating system (“jailbreaking” or “rooting”) can lead to additional security risks, including but not limited to unauthorized users getting access to your personal data. Sense Health does not guarantee the safety of your data in these cases.

What personal information do you collect?

When you sign up for a NiceDay User Account, you are required to provide an email address (which will be used as your login ID) and to create an account password (collectively the “Registration Information”). You can choose to add additional personal details to your User Account, such as your name, age, and gender. When you decide to share data with others, we collect the information you provide about those individuals such as their name and email address.

How do we use your personal information?

We use your personal information and data to:

  • provide you with the Service;
  • analyse Service usage and improve the Service;
  • deliver to you any administrative notices and communications relevant to your use of the Sense Health Services;
  • provide you with updates regarding the Sense Health Services;
  • perform internal market research, project planning, troubleshooting problems, and to detect and protect against error, fraud or other criminal activity;
  • enforce the Sense Health Terms of Service.

Are there any exceptions that make you disclose my personal information?

In certain cases we may also disclose personal information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users or if we are required to do so by any applicable law, rule, regulation, subpoena or other legal process.

What about cookies and other technology?

The Website and Services may use “cookies” and other technologies such as pixel tags and web beacons. The app itself does not make use of cookies, although websites that are linked to from the app might.

Cookies are alphanumeric identifies in the form of text files that are inserted and stored by your Web browser on your computers hard drive. These technologies tell us which parts of our website you have visited and optimize the site for you. They are also used to analyze and improve our Services design and functionality.

We may use third party service providers to help us analyze certain online activities and improve our products and the Service. For example, these service providers may analyze visitor activity on the Website. We may permit these service providers to use cookies and other technologies to perform these services for us. We do not share any personal information about our users with these third party service providers, and these service providers do not collect such information on our behalf. Our third party service providers are required to fully comply with this Privacy Policy.

What about children?

We do not knowingly collect any personal information from children under 13. If we discover that a child under the age of 13 has provided us with personally identifying information, we will take steps to delete the information as soon as possible.

Will you send me email?

We may provide our registered customers with regular summaries of their User Account data and email alerts. We also allow users to subscribe to email newsletters and we can send an occasional promotion email for our or others goods or services. We will never share your email address with third parties, unless you explicitly agree to this.

Subscribers have the ability to opt­out of receiving our weekly summaries and promotional emails and to terminate their newsletter subscriptions by following the instructions provided in such emails.

Opting out in this manner will not end transmission of service ­related emails, such as email alerts.

What about my login information?

You are responsible for maintaining the security of your login ID and password. If you believe that your login ID or password have been compromised you should immediately change your password. We are not responsible if someone else accesses your account through registration information they have obtained from you or through a violation by you of this Privacy Policy or the Sense Health Terms of Service.

Will you change this policy?

We may update this Policy periodically. The date of the latest revision appears at the bottom of the Policy. Changes take effect immediately upon posting. In case there are significant changes to the privacy policy, we will inform you.

Which law is applicable to this privacy policy?

Sense Health Services are operated from the Netherlands and are subject to Dutch law. Any personal information that you provide to us is being stored on servers in The Netherlands. We cannot and do not guarantee that the information transferred to or from us does not cross any other servers in other countries or jurisdictions, as this is sometimes outside the scope of our control. By using the Sense Health Services, you consent to the transfer of your personal information to The Netherlands.

We process your personal data according to the GDPR regulation based on your consent. We only process your personal data after you have given explicit consent.

How long do you keep my personal data for?

We will keep your data no longer than needed: we will comply to local laws and contractual obligations.

What are my rights?

You are able to access and control your personal data:

  • The right to portability of data. The right to transfer your personal data
  • The right to remove your data. The right to be ‘forgotten’
  • The right to view your data
  • The right to rectify and update your data. The right to make additions or changes to any personal data we gather about you.
  • The right to restrict processing of data: the right to limit the amount of data we process.
  • The right related to automated decision making and profiling. With other words: the right to a human view on decisions.
  • The right to file a complaint against the processing of your data.”
